The Port of New Orleans' industrial canal; this was one of the biggest failures in urban planning in American history; it is costly, with limited benefits and immense human suffering.

In the spring of 2020, the Army Corps of Engineers will submit their Lock replacement proposal to Congress for approval and ask for $1bn in funding. The idea that we should make a decision right now to re-leverage in a system that has caused so much suffering, so much environmental degradation, the idea that we would sink a billion dollars into that and then neglect to deal with the problems that that entire system created is madness.

With sea level rise, with our exposure to storms here, with the survivability of this city..... 

If we want to survive into the next century, we want our communities to thrive, we want our landscape to be whole, we got a lot of work to do that is going to cost a good bit of money and that's got to happen before we start talking about replacing something like this lock

RISE St James STOP Formosa

 The US government has placed further delays on a proposed multibillion dollar plastics plant in south Louisiana, marking a major victory for environmental activists and members of the majority Black community who have campaigned for years against construction.

The planned $9.4bn petrochemical facility, owned by Formosa Plastics, would roughly double toxic emissions in its local area and, according to environmentalists, release up to 13m tonnes of greenhouse gases a year, the equivalent of three coal-fired power plants, to become one of the largest pollution-causing plastics facilities in the world. [Oliver Laughland]

The 14 separate plastic plants, spread over a gargantuan 2,300 acres of land in St James Parish, could also emit up to 15,400 pounds of the cancer causing chemical ethylene oxide [which would make the plant the second largest air emitter of ethylene oxide in the state and third largest in the nation, according to TRI data and DEQ permit filings. For benzene, Formosa would be allowed to release 73,160 pounds per year, which would make it the second largest air emitter in the state, only behind the Shell Norco chemical facilities.-- David Mitchell].

Public Meetings and Pre-proposal Recommendations on Revising the Definition of “Waters of the United States”

 

The U.S. Environmental Protection Agency and the Department of the Army recently announced upcoming community engagement on the agencies’ plans to write a new definition of “waters of the United States” (WOTUS) under the Clean Water Act to better ensure clean and safe water for all. EPA and Army are committed to providing certainty by developing a reasonable, effective, and durable definition of WOTUS that protects public health, the environment, and downstream communities and economies, while supporting agriculture and other industries.

 

Public meetings will be held on August 18, 23, 25, 26, 31 and September 2, 2021. The meeting on August 25, 2021 is for small entities, including small governments and small non-profits. In addition, the agencies are initiating Federalism and Tribal consultations for the foundational rule that would restore the regulations defining WOTUS that were in place for decades until 2015, with updates to be consistent with relevant Supreme Court decisions.

In addition, the agencies are requesting feedback on how to better engage to ensure input is received from communities with environmental justice interests. How does the jurisdictional status of waters affect communities that are overburdened with environmental pollution? How is the implementation of NWPR impacting low-income communities, and other disadvantaged communities? Can the jurisdictional status of waters be linked to environmental justice concerns, and, if so, what is the basis? Pre-proposal feedback can be provided to the agencies during the public meetings or via the docket at https://www.regulations.gov/docket/EPA-HQ-OW-2021-0328. The docket closes on Friday, September 3, 2021.

 

Background:

 

“Waters of the United States” is a term in the Clean Water Act that establishes the geographic scope of federal jurisdiction under the Act.  The engagement includes an opportunity for stakeholders and the public to provide written recommendations and a series of public meetings in August to hear perspectives on the agencies’ rulemaking process. Additionally, the agencies plan to convene regionally focused and inclusive roundtables during the upcoming fall and winter.

EPA to Hold National Environmental Justice Community Engagement Call – August 31, 2021 at 2-4pm EST

EPA invites Environmental Justice (EJ) advocates to participate in a National Environmental Justice Community Engagement Call taking place on August 31, 2021 from 2 p.m. to 4 p.m. (Eastern Time). These calls are free and open to the public.

The purpose of these calls is to inform the community and other stakeholders about EPA's EJ work and enhance opportunities to maintain an open dialogue with EJ advocates.

As environmental justice continues to be integrated into EPA programs, policies, and activities, the Agency hopes these calls will help reaffirm EPA’s continued commitment to work with community groups and other stakeholders to strengthen local environmental and human health outcomes.

The Agency will also increase the frequency of these calls to learn more from stakeholders and communities and also to provide updates about ongoing initiatives such as Justice40.

Fish Consumption Advisories

 

Baton Rouge, La. (July 29, 2021) — The Louisiana Departments of Health, Environmental Quality, and Wildlife and Fisheries today issue a series of updates to six existing fish consumption advisories.

Because of mercury contamination, there are now fish consumption advisories for 49 waterways in Louisiana and one for the Gulf of Mexico. Louisiana fish consumption advisories are based on the estimate that the average resident eats four meals of fish per month. Consuming more than this from local water bodies may increase health risks. Mercury is an element that occurs naturally in the environment. Consequently, there are small amounts of mercury in the sediments of streams, lakes, rivers and oceans. Nearly all fish contain trace amounts of mercury. They absorb mercury as they feed on aquatic organisms. Larger predator fish contain more mercury than smaller fish. It is recommended that smaller fish be consumed instead of larger ones. People are exposed to low levels of mercury throughout their lives. Eating contaminated fish is one way we are exposed to mercury. Health effects from harmful levels of mercury can include nervous system and kidney damage. Young children and developing fetuses are more sensitive to the toxic effects of mercury. Therefore, consumption advisories are issued at lower fish tissue concentrations for women of childbearing age and children under 7 years of age. It's been one year [August 2 2020] since the Bianca spill that unleashed nearly one billion plastic pellets into the Mississippi River. 

Only neighborhood volunteers stepped up to clean up the mess, not any public or private agency.

August 2 2020 a year ago there was a thunderstorm and something happened to cause the cargo ship CMA CGM Bianca to break from its Napoleon Avenue Wharf moorings. A big container onboard 'spilled millions if not billions of nurdles in the mighty Mississippi River around New Orleans. Thousands washed ashore on both sides of the river bank, including the river bank at our National Historical Chalmette Battlefield Chalmette.

"For whatever reason, Port of NOLA officials decided, oh well, the nurdles were 'irretrievable'"

Oceanographer and plastic pollution expert Benfield from the LSU School for the Coast told The Advocate, ?the nurdles would simply float and flow out to sea where some of them would be eaten by fish and other marine life."

"'Nurdles' are preproduction plastic pellets used in manufacturing and packaging.
