CITIZENS FIGHTING EMINENT DOMAIN ABUSE

The protections adopted in Louisiana’s amendments are absolutely vital to ensure that citizens who are still trying to rebuild the homes, businesses, and communities shattered by the hurricanes will not have to face the additional trauma of losing those uniquely important places that they can call their own. As long as it is not a threat to the public health and safety, property is protected by the Louisiana Constitution from the greedy ambitions of those developers whose vision of New Orleans doesn’t include its long-time residents.

Each piece of property must be a threat to public health and safety to be condemned for blight.
Condemnations for industrial parks and port facilities are forbidden on residential property.
House Bill 707 (Constitutional Amendment No. 6)
Senate Bill 1 (Constitutional Amendment No. 5 )

The new amendment does not address the power of municipalities to use eminent domain for the benefit of industrial parks since that is specifically permitted in another provision of the Louisiana Constitution. It does, however, provide that a person’s home cannot be taken for an industrial park or even for a public port facility.

The ambient air monitor site data at the Joe Davies Elementary School (known as Meraux Site on DEQs website under site data at link below) has shown exceedingly high readings for H2S in the last few days (Feb 16th, 18th, 19th and 20th) all around the same time of day. The State Agency has been asked for an explanation.

Property owners should contact GRS if they do not receive their initial LND contact letter by early March. The parish has collected a deposit on just over 400 properties and has appraised just over 300 with the average appraisal value continuing to decrease – currently – at $4,865.

As of February 2010, about 3,800 letters have been mailed representing 2,599 Louisiana Land Trust lots for which interest had been expressed. Letters are still being mailed. Property owners should contact GRS at 504-569-1905 if they do not receive their initial contact letter by early March. GRS is located in the Gulf Coast Bank building on the second floor at 1801 East Judge Perez Drive in Chalmette. After the initial contact letter, residents will be contacted by mail when further action from them is required.

"This spurs our recovery one step further," President Taffaro said. "It is much more feasible to restore a neighborhood when the slabs are removed. In total, we hope to have 6,000 slabs removed, including LLT properties and non-LLT properties. We are still hopeful that the Louisiana Recovery Authority will be able to pay for the removal of all the slabs."
